In the spirit of good practise, when you are purchasing Coaching services from All My Friends Are Eggs, we ask you to confirm that you have read and agreed to each statement below and that you wish to proceed.
Take the time to read this, please. You’ll get way more out of your Coaching sessions and it’s important that we are on the same page when working together as the “Coach” (Manny Tura) and “Client” (you).
All Coaching services and communication, email or otherwise, delivered by Manny Tura (“Coach”), as well as information on the website allmyfriendsareeggs.com are meant to help you identify the areas in your life and in your thinking that may be preventing you from experiencing greater well-being and moving forward.
All My Friends Are Eggs is continually striving to ensure that the standard of service we provide to its clients remains excellent. At the end of the Coaching program or series of coaching sessions, the client will be asked to complete a feedback form or provide a testimonial and this can be provided at the discretion of the Client.
The term ‘coaching’ as here used covers health coaching, life coaching, personal coaching, executive coaching and business coaching for clients.
Disclaimer
I understand that the coaching services I will be receiving from my Coach are not offered as a substitute for professional health care or medical care and are not intended to diagnose, treat or cure any health or medical conditions. I also understand that my Coach is not acting as a medical professional.
For legal purposes, I understand that coaching is currently an unregulated industry and that my Coach is not “licensed “ by any UK body even though the sessions may take place in the UK.
I understand and agree that I am fully responsible for my well-being during my coaching sessions, and subsequently, including my choices and decisions.
I understand that all comments and ideas offered by my Coach are solely for the purpose of aiding me in achieving the defined goals I create with my Coach. I have the ability to give my informed consent and hereby give such consent to my Coach to assist me in achieving such goals and understand that results are not guaranteed.
I understand that my Coach will protect my information as confidential unless I state otherwise in writing. If I report child, elder abuse or neglect or threaten to harm myself or someone else, I understand that necessary actions will be taken and my confidentiality agreement limited in this capacity. Furthermore, if my Coach is ordered by a court to provide information or to testify, they will do so to the extent the law requires.
I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, video conferencing software and other technology.
I hereby release, waive, acquit and forever discharge my Coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself or by my Coach as a result of the advice given by my Coach or otherwise resulting from the coaching relationship contemplated by this agreement.
I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents.
Responsibility
Your Coach will do everytihing possible to support you in achieving your own results and desired coutcomes.
You are responsible for the cause of all change in your life.
Your Coach will work with you to identify solutions and offer suggestions, options and advise based on their own personal experience, training and the information appropriate.
You accept full responsibility for all decisions and courses of action.
You as Client, by agreeing to these Terms and Conditions acknowledge that the Coach is not a medical professional or doctor. You are advised to consult your doctor or a qualified health professional regarding specific health questions. Neither All My Friends Are Eggs or your Coach takes responsibility for possible health consequences of any person or persons reading or following the information in this educational content or programs. All Clients, especially those taking prescription or over the counter medications, should consult their doctors or medical professional before beginning any lifestyle, nutrition or supplement program.
Free Communication Access
There is no extra charge for brief “catch up calls” or messages via e-mail or instant messaging between your Coaching Sessions, whether to discuss an issue or concern or share something great! Your Coach provides this free additional service to give your superior value and results.
Your Coach is available Monday to Friday between 09:00 and 18:00, and Saturday 09:00 to 13:00 via email or instant messaging to share wins, seek clarity on actions or review minor issues. Again, there is no charge for any of the brief “catch up emails” or “catch up messages”.
Confidentiality
Your Coach will not divulge that you are in a coaching relationship without your express consent. You, of course are free to discuss the coaching relationship with anyone at anytime.
Scheduling
All Coaching Sessions are scheduled in advance by direct agreement between you and your Coach. If for any reason you cannot attend a scheduled Coaching Session you are fully responsible for informing your Coach and arranging an appointment at least 48 hours in advance, otherwise the session will be deemed forfeit. You are responsible for rescheduling via phone or contact (and receive reply) via email or a instant messaging application.
Tasking
Tasks are assigned to assist in accelerating your change and the achievement of your desired results.
Terms of Coaching
The Coaching Programs are created and sold as whole packages and cannot be altered or partially completed in any way. If you are enrolled in continuing Coaching for a number of sessions, unused sessions due to quitting the program may not be eligible for refund, credit or transfer.
Coaching Calls
Coaching calls are over the phone or online via a Video Conferencing application, also this application may change without prior notice. The required communication methods and applications required for you and the Coach to communicate will be discussed before the Coaching Program begins.
Additional Sessions
The Coach may agree to provide additional coaching sessions after completion of the initial agreed session(s). These terms and conditions will apply to any additional sessions provided and the Per Session Fee will remain the same as originally agreed except where the Coach notifies the Client in writing by e-mail of a change to the Fee or to any other term or condition.
Rearranging Sessions
If you need to rearrange a coaching session, you must provide at least 48 hours notice. No refunds will be given to clients for unused coaching sessions unless 48 hours notice has been given. In exceptional circumstances the Coach may need to rearrange a coaching session. In those instances, the Coach will also give the Client 48 hours notice where practical.
Where a client pays for a session or sessions in advance they must have the coaching session(s) that they have paid for within 3 months of the payment or their fee is forfeited.
Payment Plans
If any installment payment should default, the Client will have seven (7) days to rectify the situation. Any scheduled coaching session(s) will be postponed until payment is received within the 7 days, all discounts and bonuses will be forfeited and full payment will apply. If a Client should default on any installment payment, the result may be cancellation from the Program and the Cancellation Policy will apply. A credit/debit card decline or non-sufficient funds (NSF) will result in penalty from our payment processing company in cases of payment default.
Program Changes
The Coach reserves the right to change, modify or cancel any programs as considered necessary. Any such change will be made in consultation with the Client.
Mutual Agreement Cancellation
If at any time either the Client or Coach believe the Coaching Sessions and agreement are no longer serving the needs of the Client, they may initiate a discussion to rectify the situation proir to cancelling the Program or Sessions.
Intellectual Property
All material relating to the Program is subject to copyright and other intellectual property rights. All materials may not be recorded, used or reproduced without the written permission of the owner.
Indemnification
You understand that all action taken is performed voluntarily and is your own responsibility. Clients should seek independent professional advice before undertaking any physical or health actions.
Early Termination or Suspension of Memebership
In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the Client, actual or potential conflict of interest, or other reasons, the Coach can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the Client. In such a circumstance the Client will be given reasonable notice of termination by the Coach where practicable and will be refunded any advance payments made for coaching sessions not yet provided.
Notice of Cancellation
If you wish to cancel the agreement and payments within 5 business days of the date indicated you may do so for a full 100% refund of any monies paid less the cost of any products delivered. This refund is only available if services have not commenced in any way rendering any refund void.
Notice of cancellation must be in writing and delivered by email to manny@allmyfriendsareeggs.com. Cancellation notice will be deemed on the date in which the cancellation is received and acknowledged by the Coach. No refunds, credits or transfers available for no-shows.
Agreement Section
By entering into a Coaching Agreement with All My Friends Are Eggs, either through signing a Coaching Agreement with the Coach or paying any amount to your Coach, you agree to abide by the terms and conditions as set out above.
